General Rental Terms

Preamble

These general rental terms govern the contractual relationship between YSconcierge (hereinafter "the Company") and the renter (hereinafter "the Renter") for vehicle rental.

By signing the rental agreement or accepting these terms during online booking, the Renter acknowledges having read these general terms and accepts them without reservation.

Article 1 - Renter Requirements

The Renter must be at least 25 years old. Foreign driver's licenses that are not translated or illegible are not accepted. The driver's license must be presented when picking up the vehicle and remain valid throughout the rental period.

If the vehicle may be driven by another driver, they must first sign the rental agreement and also meet the above requirements. In case of damage to the vehicle, a deductible may be charged to the renter (see Article 6).

Article 2 - Fuel

Vehicles are rented with a full tank of fuel, and the Renter agrees to return them with a full tank as well. For electric or hybrid vehicles, the same rule applies for battery charge.

Battery charging or refueling costs not completed will be charged to the Renter at the public price plus a CHF 50 administrative fee.

Article 3 - Contract Formation

The rental contract is concluded upon booking confirmation by the Company and acceptance of these terms by the Renter. The booking is only final after receipt of full payment or the agreed deposit.

Article 4 - Rental Price

The rental price is as indicated in the rental contract. It includes the agreed mileage allowance. Additional kilometers will be charged at the rate specified in the contract. All prices are in Swiss francs (CHF) and include VAT.

Article 5 - Payment Terms

Full payment must be made before vehicle pickup, unless otherwise agreed with the Company. Accepted payment methods are: bank card, bank transfer, or cash (up to CHF 1,000). Online payments are secured through our partner Stripe.

Article 6 - Security Deposit

A security deposit will be required when picking up the vehicle. The deposit amount is indicated in the rental contract and varies according to the vehicle type.

This deposit will be used to cover any damage to the vehicle, missing fuel charges, fines or traffic violations, and any other charges attributable to the Renter.

The security deposit will be returned to the Renter within 10 business days after vehicle return, less any amounts owed to the Company.

Article 7 - Vehicle Handover

The vehicle is handed over to the Renter in impeccable condition, clean and with a full tank of fuel (or charged battery for electric vehicles). A joint inspection is performed at handover and return of the vehicle.

The Renter agrees to check the vehicle's condition upon pickup and immediately report any existing defects or damage. Any unreported damage will be presumed to have occurred during the rental period.

Article 8 - Vehicle Use

The vehicle must be used responsibly and in accordance with its normal purpose. The Renter agrees to comply with traffic laws and all applicable regulations.

Only the Renter and additional drivers listed in the contract are authorized to drive the vehicle.

It is strictly prohibited to:

  • Transport passengers for remuneration
  • Sublet the vehicle
  • Participate in competitions, races or tests
  • Transport dangerous, flammable or prohibited goods
  • Drive under the influence of alcohol, drugs or medication
  • Use the vehicle on closed circuits or impassable roads
  • Cross national borders without prior written authorization
  • Smoke in the vehicle (minimum CHF 500 cleaning fee)

Any violation of these rules will result in immediate termination of the contract and billing of corresponding fees.

Article 9 - Vehicle Return

The vehicle must be returned on the date, time and location agreed in the rental contract, in the same condition as at pickup, clean (inside and out) and with a full tank of fuel.

Any delay in vehicle return will be charged at the current daily rate plus 50%. In case of delay exceeding 2 hours without prior notification, a full day will be charged.

If the vehicle is returned dirty, cleaning fees will be charged (interior: minimum CHF 150, exterior: minimum CHF 80).

Vehicle keys and documents must be handed over in person to a Company representative or according to given instructions.

Article 10 - Rental Extension

Any extension of the rental period must be agreed in writing with the Company at least 24 hours before the scheduled return date. The extension will be charged at the current rate and subject to vehicle availability.

Article 11 - Early Return and Termination

In case of early vehicle return, no refund will be made for unused days unless previously agreed with the Company.

Cancellation conditions:

  • Cancellation more than 7 days before rental start: full refund minus CHF 100 administrative fee
  • Cancellation between 3 and 7 days before: 50% refund of total amount
  • Cancellation less than 3 days before: no refund

The Company reserves the right to terminate the contract at any time in case of non-compliance with these terms by the Renter, without refund and with billing of corresponding fees.

Article 12 - Insurance

Vehicles are insured for civil liability in accordance with Swiss law. Comprehensive insurance is included in the rental price, with a deductible payable by the Renter in case of an at-fault claim.

The deductible amount varies according to the vehicle and is indicated in the rental contract. The Renter may purchase a deductible waiver option to reduce this amount.

Insurance does not cover:

  • Intentionally caused damage
  • Damage caused under the influence of alcohol or drugs
  • Damage to tires, rims, windshield and vehicle interior
  • Personal effects of the Renter
  • Fines and traffic violations

Article 13 - Incident Occurrence

In case of accident, theft, fire, damage or any other event, the Renter must:

  • Immediately notify the Company by phone
  • Call the police if necessary (accident with injuries, theft, etc.)
  • Complete an accident report if applicable
  • Not admit liability to third parties
  • Take photos of the damage
  • Submit all documents to the Company within 24 hours

The Renter agrees to cooperate fully with the Company and the relevant authorities.

In case of non-compliance with these obligations, the Renter will be held liable for all damages.

In case of an at-fault claim, the contractual deductible will be withheld from the security deposit or billed to the Renter.

The vehicle must not be moved after an accident without the Company's consent, except for safety reasons.

Article 14 - Breakdown and Technical Defect

In case of breakdown or technical defect not attributable to the Renter, the Company will make every effort to provide a replacement vehicle as soon as possible. If no vehicle is available, the Renter will be refunded pro-rata for unused days. The Company cannot be held liable for indirect consequences of a breakdown.

Article 15 - Renter's Liability

The Renter is responsible for the vehicle throughout the rental period, including in case of theft or damage caused by a third party.

The Renter is responsible for payment of all fines, traffic violations and legal fees resulting from vehicle use. An administrative fee of CHF 50 will be added for each violation processed.

The Renter is responsible for damage caused to the vehicle and its equipment, as well as immobilization costs during repairs (calculated at the current daily rate).

Article 16 - Company's Liability

The Company commits to providing a vehicle in perfect working order and compliant with safety standards. The Company's liability is limited to the rental amount. The Company cannot be held liable for indirect damages, loss of time, lost profits or any other harm resulting from the use or inability to use the vehicle.

Article 17 - Geolocation

Vehicles are equipped with a GPS tracking system for security and theft protection purposes. The Renter consents to this tracking throughout the rental period. Geolocation data is processed in accordance with our privacy policy.

Disabling or tampering with the GPS system is strictly prohibited and will result in immediate contract termination and billing of damages.

Article 18 - Extraordinary Termination

The Company reserves the right to terminate the contract with immediate effect and recover the vehicle in case of: non-payment, violation of terms of use, dangerous or inappropriate behavior, suspicion of fraud or unlawful vehicle use. In this case, no refund will be made and the Renter will be required to pay all associated costs.

Article 19 - Severability Clause

If any provision of these general terms is held to be null or unenforceable, the remaining provisions shall remain in effect. The null provision shall be replaced by a valid provision that most closely approximates the original intent.

Article 20 - Applicable Law and Jurisdiction

These general terms are governed by Swiss law. Any dispute arising from the rental contract shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
